Two Colorado Springs police officers were justified in fatally shooting a misdemeanor theft suspect armed with a BB gun Dec. 2, the District Attorney's Office ruled Tuesday. Officers Christopher Fernandes and Tracy Toth drove to the parking lot behind a strip mall in the 1500 block of South Nevada Avenue to arrest Christopher Louis Willard, 33, for failure to appear, the 4th Judicial DA's Office reported. The DA's Office gave this account: The officers, who knew Willard, saw his vehicle in the lot and approached him and another man, who were standing near his vehicle. Willard "walked to the front of his vehicle and stood by the open driver's side door" when Fernandes approached.
