A federal district judge in San Francisco has scheduled a hearing Monday over whether the retired federal judge who struck down California's ban on same-sex marriage should have his ruling wiped from the legal record because of his relationship with a man.

A judge in Dallas ruled on Thursday that the state court on which she sits has the jurisdiction to hear a divorce suit by a gay couple who were married outside Texas where same-sex marriages are banned.

With the California Supreme Court likely to uphold Proposition 8 but still recognize those already married, the couples are feeling both elated and isolated. Jeanne Rizzo, 62, who married her partner of 20 years in September, was "somewhat heartened" Friday that her marriage is poised to survive Proposition 8 -- but she was not celebrating.

The California Supreme Court is hearing arguments Thursday on the future of a ballot initiative that outlawed such unions.
