WILKES-BARRE — The case of a caregiver accused of sexually assaulting a non-verbal, mentally challenged patient appears slated to go before a jury following the suspect’s second rejection of a plea deal during bitter legal battle that played out in a county courtroom Monday. “Absurd” and “unprofessional” were some of the terms prosecutor Nancy Violi used to describe arguments made by defense attorney Al Flora Jr., who in court Monday maintained his position from a previous hearing that his client, Andrew Dula III, will not accept the deal and admit his guilt based on prosecutors’ factual basis of the charge. Dula, 54, of Shickshinny, is charged with assaulting a 36-year-old patient at Community Living, a home for patients with disabilities in Kingston operated by the nonprofit Institute for Human Resources and Services.
