The election scheduled for 2013 was upended in an almost yearlong legal joust that took plaintiffs from a state appeals court to a federal circuit court in Washington, D.C., back to a the 172nd District Court, which has had jurisdiction since the Texas Ninth Court of Appeals sent it there. Michael Getz, one of the attorneys for a group of candidates who tried to gain a place on the school board ballot, said the state education code says a board of managers must call for an election within two years of the board's appointment, which means the current board must call for the next regularly scheduled election for May 2017 unless it calls for an out-of-cycle election at the next available general election day, November 2016.
