Yesterday's arguments at the U.S. Supreme Court make it almost certain that the Defense of Marriage Act is dead. Either Chief Justice John Roberts will assemble a 5-vote majority to deny standing to the Obama administration and Congressional Republicans to bring the case in the first place, or Justice Anthony Kennedy will join the court's moderates to declare the law unconstitutional.
