By Andrew Brown Republican gubernatorial candidate Bill Cole is seizing on two new tax liens that have been filed against Jim Justice's Greenbrier resort as the latest example of the Democratic candidate for governor not paying his bills. On Tuesday, Justice's campaign responded to the Republicans' release of the nearly $750,000 in unpaid bills for cleanup services following the deadly flooding in June by saying that it was up to the resort's insurance company to pay the bill. Justice campaign spokesman Grant Herring provided the Gazette-Mail with a statement from the insurance company's CEO declaring that the costs of the flood cleanup would be covered under the Greenbrier's insurance plan, and that BMS CAT Inc., the flood remediation contractor that filed the liens, would be paid in the near future. "I understand that The Greenbrier believed that BMS-Cat's bill would be paid directly by the insurance carriers and, therefore, The Greenbrier did not put the unpaid bills into your Accounts Payable system, resulting in the bills not having been paid on a timely basis," Gregory Riehle, the CEO of Resort Hotel Association, said in the email provided by the Justice campaign. The type of lien that was filed against The Greenbrier is common for contracting disputes and is a required procedural step if contractors want to take a customer to court at a later date for unpaid bills. "Speaking generally, it is not uncommon for payment mistakes and disputes to result in liens being filed against property owners as a precaution," said Riehle. The Cole campaign tried Tuesday to tie the liens to stories of unpaid bills that have dogged Justice throughout the campaign.
